House Bill Will Halt Clean Water Act Rule

On Aug. 28, 2015 the U.S. Environmental Protection Agency & the U.S. Army Corps of Engineers' rule expanding federal jurisdiction over navigable waters, known as 'waters of the U.S.,' went into effect. This rule is a drastic expansion of federal jurisdiction that will cause delays in obtaining federal Clean Water Act permits and increase construction costs.
This week, the House is expected to vote on the Senate-passed, AGC-supported legislation, a Joint Resolution of Disapproval Under the Congressional Review Act (S.J. Res 22). This bill halts the rulemaking and blocks further rules that are substantially similar. This rule needs to be drastically changed before it is workable for the construction community. Currently, the rule has been temporarily stayed by the 6th Circuit.
