New 2012 NM Resident Certificates Required to Qualify for 5% Bidding Advantage

New Mexico companies or contractors who wish to obtain a five percent bidding advantage on all state contracts are required to obtain a valid resident business certificate or resident contractor certificate issued by the State Taxation and Revenue Department starting Jan. 1, 2012. The in-state preference does not apply to contracts that use federal funding.

The in-state procurement reforms took effect on October 5, 2011, when Governor Susana Martinez signed Senate Bill 1 from the special legislative session into law. However, the validity of existing resident contractor certificates expired on  December 31, 2011.  As of January 1, 2012, all resident contractors and companies desiring an in-state preference for state and locally funded procurements are required to meet the new law's requirements as demonstrated with a new certificate.
