What is the New Mexico Building Branch, AGC Comp Trust?

It is a self-insured workers’ compensation program for AGC Members.

AGC Comp Trust, as a separate not for profit organized and existing under the laws of the State of New Mexico, is a strategic outcome of the sponsoring association, the New Mexico Building Branch, Associated General Contractors (AGC). AGC leadership agreed to create an alternative program offering workers’ compensation for New Mexico commercial contractors. The Trust now offers a full range of services, including managed care for work related injuries, safety and loss control services, OSHA inspection assistance and employee safety training. All of these features of AGC Comp Trust are designed to assist participants in controlling work related accidents. When losses are reduced, the cost is reduced. Because the AGC Comp Trust is owned by its participants, they share in the monies not allocated to losses or operational expenses.

AGC’s Board of Directors seized an opportunity to invest resources, expand the service package, grow the membership and strengthen credibility by representing a contractor-employer base, with commitment to pursuing safety excellence, recognized by NM State OSHA. The association mission states “provide a forum through which members, with staff, can ……develop programs designed to improve the well-being of the construction industry, the communities in which they live, and the profitability of their own businesses…” providing a long-term, stable solution to workers’ compensation, while pursuing safety excellence for members of the chapter who qualify as participants in AGC Comp Trust.

Fund Description: Beginning on October 1, 2004 AGC Comp Trust received approval to operate a pooling of workers’ compensation liabilities. The AGC Comp Trust’s Board of Trustees chose to strengthen credibility by representing a contractor employer base whose commitment to pursuing safety excellence is paramount to its operation. This commitment to safety excellence makes participants more profitable and competitive in the commercial construction industry, which in turn strengthens AGC members and the construction profession in New Mexico. It provides a unique opportunity for participants to actively participate in the management their own workers’ compensation losses and thereby minimize their overall costs.
